IIC, Inc.’s professionals have extensive experience working in and consulting to various facets of the computer industry. We have worked for major computer hardware and software manufacturers providing litigation support, expert testimony, business strategy and marketing assistance and advice. We have also studied market trends in the industry as they have emerged over the years, including the use of various forms of e-commerce such as electronic data interchange, e-business and e-procurement. We have valued privately-held companies in this industry in both the United States and abroad, as well as selected intangible property including software.

We apply our understanding of industry trends as well as the process of technological innovation to provide our clients in-depth knowledge of what to expect in the future as well as how economic factors influence growth and profitability in this industry.

For a major computer manufacturer, we developed and implemented a strategic plan for market­ing its com­puter technology to law firms and other legal entities. This assignment involved devel­oping an overall understanding of the legal marketplace and the demand for technology to support litigation as well as planning a strategy to assist in properly positioning the company’s products. We then assisted our client by giving presentations throughout the country that demonstrated the cost-effectiveness of this technology solution for the legal marketplace.

IIC, Inc. authored a report on the diffusion of electronic data interchange (EDI) technolo­gy and its effects on small business. This work involved the design and implementation of a survey of users of this technology, and how it related to the competitiveness of those users in their respective markets. This report recommended various policy options to assist small firms in using this technology and thereby compete more effectively with larger users of EDI.

IIC, Inc. analyzed the intangible value of various software programs that were under development in order to develop a royalty and a buy-in payment under an R&D cost sharing agreement. We analyzed the stage of development of the software and the costs required to bring these programs to market as well as the likely market potential. We also critiqued the analysis of the opposing expert and assisted counsel in resolving the matter prior to trial.

For the U.S. Small Business Administration, IIC, Inc. examined the impact of electronic commerce and procurement by the federal government, and whether small firms had sufficient tools and expertise to adopt technology and business processes to compete effectively in the e-commerce arena. The study concluded that small firms generally are less effective in taking advantage of e-business and e-procurement tools, although small firms are making improvements in their ability to attract business via the web.

IIC, Inc. supported the work of an academic economist to analyze the purchasing behavior of consumers of Windows-based computers. We constructed a survey instrument and performed a detailed survey to demonstrate that damages could not be shown to be common to a class of purchasers of Microsoft software.

IIC, Inc. staff members have worked on several antitrust matters in the computer industry including those involving IBM and Microsoft. This work has required an in-depth understanding of the business and technical aspects of the industry as well as consumer behavior, market trends and the rate and drivers of technological progress in the industry.

For a small, privately-held computer software and services firm, we analyzed a claim of lost profits as a result of a breach of contract that caused the firm to lose several key customers. We analyzed the profits of the firm as well as developed measures of the value of the firm both pre- and post-breach to show that the economic damages included a significant diminution of the goodwill of the company. Our work was instrumental in our client obtaining a very favorable settlement in the matter.
